Property group calls off initiative

Gazette State Bureau: A group has decided not to pursue a constitutional “takings” ballot measure after all but instead will bring it up at the Legislature.

“This is a major piece of legislation, and we want to make sure it’s done right,” said Chuck Denowh, policy director of the United Property Owners of Montana. “We want to ensure it does exactly what we think it does, and that there are no unintended consequences. This law is an absolute necessity for Montana, and the best way to achieve it is through the legislative process.” With property rights of all Montanans under attack on multiple fronts, he said new protections are needed to ensure that future generations have the same economic opportunities now enjoyed.

In a press release Friday, the group said it has several ideas for legislation that would make it harder for government entities and special-interest groups to erode property rights. Its main bill is a comprehensive regulatory takings statute that would give property owners legal recourse if a government regulation reduced the owner’s property value by at least 25 percent.
