Iowa voters could seek Constitution changes in 2010

Des Moines Register: There is a way to amend the state Constitution that possibly could put an amendment about gay marriage before voters before 2012, Iowa constitutional scholars said today.  The 22nd Amendment to the Iowa Constitution, adopted in 1964, made it mandatory for general election ballots, beginning in 1970, to include the question every 10 years. That means voters will be asked in November 2010 if they want a constitutional convention. If voters decide next year by a simple majority that they want a constitutional convention, Iowa voters could have a constitutional amendment to approve by referendum as early as a special election in 2011. The other way of amending the constitution, where two consecutive Legislatures need to pass a measure, would get a referendum on a general election ballot no earlier than November 2012. The constitutional convention would not entirely bypass the Legislature, however. If voters call for a convention, it would be up to the Legislature in its next regular session to decide how delegates to the convention would be elected and how any proposed amendments would be submitted to voters.
