St. Louis Post-Dispatch: An initiative petition drive to repeal Missouri’s nonpartisan court plan passed its first hurdle Tuesday.
Secretary of State Robin Carnahan approved the petition’s form and released the ballot title that will be used if supporters collect enough signatures to get the constitutional amendment on the ballot in November 2010. The title is straightforward: “Shall the Missouri Constitution be amended to repeal the current nonpartisan court plan for the selection of judges of the Supreme Court, Court of Appeals, and Courts in St. Louis City and Jackson, Platte, Clay, St. Louis, and Greene Counties and to create a new method of selecting such judges through appointment by the Governor with advice and consent of the Missouri Senate?” “It’s fair ballot wording,” said James Harris, a Republican consultant who submitted the petition on behalf of a group called Better Courts for Missouri. The group contends that plaintiffs’ lawyers have too much say in the current selection system. Under that plan, Missouri relies on nonpartisan panels to screen applicants for appellate judgeships and circuit courts in urban areas. When vacancies occur, the governor chooses from among three nominees submitted by the screening panel.
The petition would adopt a model similar to the federal selection system, where the president chooses judges subject to confirmation by the U.S. Senate. “George Washington and James Madision devised this,” Harris said. “People understand the federal system.”
